The issuer/operator is Fritz Berger GmbH, Fritz-Berger-Str. 1, 92318 Neumarkt, Germany, (hereinafter Fritz Berger). Any consumer who has reached the age of 18 may participate in the Fritz Berger Advantage Card Bonus Program. Employees of Fritz Berger GmbH and entrepreneurs are excluded. In accordance with § 13 of the German Civil Code (BGB), a consumer is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to his/her commercial nor to his/her independent professional activity. According to § 14 BGB, an entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of his commercial or independent professional activity.
By applying for registration as a participant, you accept these general conditions of participation. In doing so, the application form must be filled out completely and truthfully in the mandatory field areas, signed and handed in at a Fritz Berger branch. Online registration is possible at www.Fritz-Berger.de. After positive verification of your application, we will send you your Fritz Berger advantage card by mail or hand it over directly with this application at the branch. The advantage card is intended exclusively for you and is not transferable. There is no entitlement to participate in the bonus program. any changes to your data provided in the application form must be notified to us immediately in writing to Fritz Berger GmbH, Fritz-Berger-Str. 1, D-92318 Neumarkt or by e-mail to service@fritz-berger.de.

Collecting and redeeming the bonus
With every purchase at Fritz Berger [online order at www.fritz-berger.de, Fritz Berger stores as well as orders by telephone and in writing (letter, fax, e-mail) from the Fritz Berger catalog], the value of your purchase (calculated sales price of the purchased items after deduction of any discounts and bonuses granted, excluding shipping costs) will be credited to your advantage card bonus account. Excluded from the bonus program are purchases at Fritz Berger via sales platforms that are not operated by Fritz Berger, such as Amazon or Ebay, as well as sales at partner companies and the purchase of gift vouchers. When shopping in the store, it is necessary to show your advantage card before the payment process. For purchases in the online store, it is sufficient to enter your login information! If a purchase contract is fully or partially reversed, the reversed value of goods will be charged back to your advantage card bonus account. you can obtain information about the current amount of your sales at any time via our contact form, on the Internet at www.fritz-berger.de under "My Account" or in any Fritz Berger store.
Up to € 99.99 calendar year turnover -> no bonus
from € 100.00 calendar year turnover -> 3% of calendar year turnover
from 1.000,00 € calendar year turnover -> 5% of calendar year turnover
Example: Your calendar year turnover 2019: 1,749.95 € -> your bonus voucher: 87.50 €. a voucher will be created for the bonus to which you are entitled and sent to your address by mid-March of the following year. The bonus voucher is valid until 31.12. of the same year in which you received the voucher. The voucher can be redeemed at any time when shopping at Fritz Berger (online orders at www.fritz-berger.de, Fritz Berger stores as well as telephone and written (letter, fax, e-mail) orders from the Fritz Berger catalog). Redemption via shopping platforms is not possible. There is no entitlement to cash payment of the bonus/voucher amount. Should you wish to raise any objections to our settlement, please send them to us in writing, enclosing the relevant invoice copies/cash register receipts and the original voucher within 3 months of receipt of the bonus settlement/voucher. This will be pointed out to you again separately in the bonus statement. Unfortunately, we cannot accept late objections. Please store your vouchers carefully like cash, as we cannot replace lost vouchers.

Voluntary 100-day return policy
The voluntary right of return applies to all articles that you have ordered from our online store at www.fritz-berger.de, in Fritz Berger stores, by telephone or in writing (letter, fax, e-mail) from the Fritz Berger catalog. The period is 100 days and begins on the day after receipt of the goods. You can exercise this right by returning the items within 100 days to a Fritz Berger branch or by sending them back to us, whereby timely dispatch of the items is sufficient. Fritz Berger will pay the return shipping costs for you. The voluntary right of return only applies to unused goods that you have only inspected with regard to condition, properties and functionality, as is customary in a retail store. In addition, the goods must be complete (including accessories and any manuals and instructions for use) and undamaged and must be returned or sent back in the original packaging as delivered. The voluntary right of return does not apply to the purchase of gift vouchers and not to contracts for the supply of goods that are not prefabricated and for the manufacture of which an individual selection or determination by you is decisive or which are clearly tailored to your personal needs. If you are entitled to a statutory right of revocation (for contracts concluded outside business premises and for distance contracts), this shall not be affected by the voluntary 100-day right of return, but shall remain in full force and effect independently of this. Your statutory warranty rights are also not limited by our voluntary right of return, but remain unrestricted.

Exchange of articles
Advantage card holders can also return all articles purchased in Fritz Berger stores during the above-mentioned period for which the advantage card was presented, even without the original sales slip, and receive a refund of the purchase price paid. For this refund, we will use the same means of payment that you used for the original transaction.

Cancellation/termination of participation
You may terminate your participation in the Fritz Berger Advantage Card Bonus Program at any time without notice, as follows: By written notice sent by mail to: Fritz Berger GmbH, Fritz-Berger-Str. 1, 92318 Neumarkt, Germany. By notification by e-mail to service@fritz-berger.de. In addition, Fritz Berger GmbH is entitled to partially or completely discontinue the bonus program at any time.

modification of the bonus program
Furthermore, Fritz Berger reserves the right to change these general conditions of participation. you will receive prior written notification of the changes at your registered address. If you do not object in writing to Fritz Berger GmbH within two months, the changes will be considered approved. Approval is also deemed to have been given if you have a new turnover credited to your account after receiving the amended conditions. These legal consequences will be expressly pointed out to you again in the written notification of the changes. You are of course free to terminate your participation in the bonus program at any time.

Loss of bonus card
If you lose your bonus card or if your bonus card is stolen, you are obliged to inform us immediately. In this case you can apply for a replacement card free of charge.

Dispute resolution
We will endeavor to settle any disputes arising from our contract with you amicably. Beyond that, we are not obligated to participate in arbitration proceedings and unfortunately cannot offer you participation in such proceedings.
